　　自动进口许可证申请的流程和所需的资料:

　　1、界定:进口属于自由进口的货物，不受限制。基于监测货物进口情况的需要，国务院外经贸主管部门和国务院有关经济管理部门可以按照国务院规定的职责划分，对部分属于自由进口的货物实行自动进口许可管理。实行自动进口许可管理的货物目录，应当至少在实施前２１天公布。进口属于自动进口许可管理的货物，均应当给予许可。属于《自动进口许可管理货物目录》内的货物进口时，必须申请自动进口许可证。

　　《自动进口许可证》（自动进口许可机电产品除外）监管证件代码为“7”。

　　机电产品《自动进口许可证》监管证件代码为“O”。

　　加工贸易《自动进口许可证》监管证件代码为“v”，管理商品有原油、成品油。

　　实行自动进口许可管理的货物目录，包括具体货物名称、海关商品编码，由商务部会同海关总署等有关部门确定和调整。该目录由商务部以公告形式发布。

　　2、适用范围

　　本流程适用于一般产品自动进口许可证的申请与发证程序，特定产品（如机电产品、汽车产品、固态棕榈硬脂、天然橡胶等）的自动进口许可证的申请与发证程序，“办事流程”栏项下“外贸管理与许可证件”类别相关流程。

　　3、发证机构

　　商务部授权配额许可证事务局、商务部驻各地特派员办事处、各省、自治区、直辖市、计划单列市商务（外经贸）主管部门以及部门和地方机电产品进出口机构（以下简称发证机构）负责自动进口许可货物管理和《自动进口许可证》的签发工作。

　　4、相关政策要点

　　（一）收货人符合国家关于从事自动进口许可货物有关法律法规要求的，可申请和获得《自动进口许可证》。

　　（二）以下列方式进口自动许可货物的，可以免领《自动进口许可证》。

　　A加工贸易项下进口并复出口的（原油、成品油除外）；

　　B外商投资企业作为投资进口或者投资额内生产自用的；

　　C货样广告品、实验品进口，每批次价值不超过5000元人民币的；

　　D暂时进口的海关监管货物；

　　E国家法律法规规定其他免领《自动进口许可证》的。

　　（三）进入中华人民共和国保税区、出口加工区等海关特殊监管区域及进入保税仓库、保税物流中心的属自动进口许可管理的货物，不需申领自动进口许可证。如从保税区、出口加工区等海关特殊监管区域及保税仓库、保税物流中心进口自动进口许可管理货物，除上述4、（二）外，仍应当领取《自动进口许可证》。

　　（四）加工贸易进口自动许可管理货物，应当按有关规定复出口。因故不能复出口而转内销的，按现行加工贸易转内销有关审批程序申领《自动进口许可证》，各商品具体申领规定详见《自动进口许可管理货物目录》。

　　（五）国家对自动进口许可管理货物采取临时禁止进口或者进口数量限制措施的，自临时措施生效之日起，停止签发《自动进口许可证》。

　　（六）海关对散装货物溢短装数量在货物总量正负5%以内的予以免证验放。对原油、成品油、化肥、钢材四种大宗货物的散装货物溢短装数量在货物总量正负3%以内予以免证验放。

　　（七）商务部对《自动进口许可证》项下货物原则上实行“一批一证”管理，对部分货物也可实行“非一批一证”管理。

　　“一批一证”指:同一份《自动进口许可证》不得分批次累计报关使用。同一进口合同项下，收货人可以申请并领取多份《自动进口许可证》。

　　“非一批一证”指:同一份《自动进口许可证》在有效期内可以分批次累计报关使用，但累计使用不得超过六次。海关在《自动进口许可证》原件“海关验放签注栏”内批注后，海关留存复印件，最后一次使用后，海关留存正本。

　　对“非一批一证”进口实行自动进口许可管理的大宗散装商品，每批货物进口时，按其实际进口数量核扣自动进口许可证额度数量；最后一批货物进口时，其溢装数量按该自动进口许可证实际剩余数量并在规定的允许溢装上限内计算。

　　二、办理自动进口许可证流程:

　　1、网上申请或者书面申请

　　2、申请时应提交的材料

　　（一）收货人从事货物进出口的资格证书、备案登记文件或者外商投资企业批准证书（以上证书、文件仅限公历年度内初次申领者提交）；

　　（二）自动进口许可证申请表；

　　（三）货物进口合同；

　　（四）属于委托代理进口的，应当提交委托代理进口协议（正本）；

　　（五）对进口货物用途或者最终用户法律法规有特定规定的，应当提交进口货物用途或者最终用户符合国家规定的证明材料；

　　（六）针对不同商品在《目录》中列明的应当提交的材料；

　　（七）商务部规定的其他应当提交的材料。

　　收货人应当对所提交材料的真实性负责，并保证其有关经营活动符合国家法律规定。

　　3、发证机构发证

　　许可申请内容正确且形式完备的，发证机构收到后应当予以签发《自动进口许可证》，最多不超过10个工作日。

　　海关凭加盖自动进口许可证专用章的《自动进口许可证》办理验放手续。银行凭《自动进口许可证》办理售汇和付汇手续。

　　4、《自动进口许可证》的有效期

　　《自动进口许可证》在公历年度内有效，有效期为6个月。《自动进口许可证》需要延期或者变更，一律在原发证机构重新办理，旧证同时撤销，并在新证备注栏中注明原证号。

　　实行“非一批一证”的自动进口许可证需要延期或者变更，核减原证已报关数量后，按剩余数量发放新证。

　　5、《自动进口许可证》的撤销与补发

　　收货人已申领的《自动进口许可证》，如未使用，应当在有效期内交回原发证机构，并说明原因。发证机构对收货人交回的《自动进口许可证》予以撤销。

　　《自动进口许可证》如有遗失，收货人应当立即向原发证机构以及自动进口许可证证面注明的进口口岸地海关书面报告挂失。原发证机构收到挂失报告后，经核实无不良后果的，予以重新补发。

　　《自动进口许可证》自签发之日起1个月后未领证的，发证机构可予以收回并撤销。
